Terms and Conditions
It is expressly agreed that all rights to exclusive use and ownership, including copyright, negatives, electronically produced images, or any material produced by the photographer and any reproductions therefrom are reserved by the photographer for the photographers benefit, whether for display, publicity, or otherwise but not limited to the above. All photographic materials (negatives, transparencies, etc.) shall remain the sole and exclusive property of Focusing On You. Focusing On You shall have the right to display or publish any of the photographs taken pursuant to this agreement and the client hereby agrees and consents to the same. This agreement qualifies as a model and / or property release.
NOTICE OF COPYRIGHT: It is illegal to copy or reproduce these photographs elsewhere without the photographers permission. Violators of the Federal Law will be subject to its civil and criminal penalties.
If the client fails to make whatever payments are required under this agreement, then all obligations of Focusing On You shall cease without any further obligations thereto the ordering contracting party. In the event of returned checks, the client is responsible for all fees incurred by Focusing On You and will pay the total amount due, in cash, no later than fourteen (14) days prior to the wedding. The same conditions apply at any point during the payment schedule.
There shall be no liability on behalf of Focusing On You, its employees, agents, assigns or licensees for their nonperformance caused by any circumstances, fire or theft, illness, accident or any other cause beyond their reasonable control. Focusing On You shall deliver proofs to the client in accordance with those standards reasonably deemed acceptable throughout the industry. Focusing On You takes utmost care with respect to exposure, development and delivery of photographic products. However, Focusing On You limits any liability for loss, damage or failure to deliver pictures or any other product for any reason, to return of all deposits.
It is understood that Edward Uhl is the official photographer retained to perform the photographic service requested. It is understood and agreed that no other photographer will be allowed to photograph or take pictures during the formal photographs or while the photographer is working. Breach of this agreement shall constitute a reason for non-completion of the job with no liability to the photographer and shall result in the loss of any retainer made by the contracting party.
On signing of this agreement by both parties, the photographer will reserve the date and times agreed upon and will not make another reservation for the specific date and time frame. For this reason, all retainers are nonrefundable even if the date is changed or if the wedding becomes canceled for any reason.
